Terms conditions

- General Terms
By booking a service or approving an offer via email, the agreement becomes binding, and the following terms and conditions apply.
- Payment Terms
- Payment is due as follows unless otherwise agreed in writing:
- Workshops: A 25% deposit is required at the time of booking, with the remaining balance due one week prior to the first workshop.
- Reports: Full payment is required at the time of registration and is non-refundable.
- For services under DKK 8.000, full payment is required upfront.
- For custom contracts with corporate clients, payment terms can be adjusted to align with internal procurement policies upon agreement.
- All prices are listed in DKK and exclude VAT unless stated otherwise.
- Late payments may incur additional fees.
- Cancellation and Rescheduling
- Deposits are non-refundable.
- For individual workshops canceled less than 30 days before the scheduled date, a 50% cancellation fee applies.
- Rescheduling without penalty is possible if requested at least 14 days before the scheduled date. Requests within 14 days are subject to a rescheduling fee unless otherwise agreed.
- In the unlikely event that ELICITOR needs to cancel a service, a full refund will be offered, or the option to reschedule to a later date will be provided
- Ownership and Use of Materials
- Clients are granted usage rights for workshop reports and materials provided for internal purposes only.
- Custom games and tools developed by ELICITOR remain the intellectual and physical property of ELICITOR and are used exclusively during the workshop or service.
- Any replication, adaptation, or continued use of these materials outside the workshop requires prior written consent from ELICITOR.
- Confidentiality
- All client information and materials shared during the project will be treated as confidential and will not be disclosed without prior consent.
- ELICITOR retains the right to showcase anonymized examples in portfolios or marketing materials.
- Client data will be stored securely and retained only for the duration necessary to deliver the agreed-upon services, in compliance with GDPR and applicable laws.
- Force Majeure
Neither party will be liable for delays or failure to perform due to circumstances beyond reasonable control, including but not limited to natural disasters, strikes, or technical failures. In such cases, ELICITOR will work with the client to reschedule or issue a refund as appropriate.
- Limitation of Liability
- ELICITOR delivers services to the best of its ability but does not guarantee specific outcomes as these depend on client participation and context.
- ELICITOR is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the deliverables provided.
- Client Responsibilities
- Clients are responsible for providing all necessary content, feedback, and resources in a timely manner. Delays caused by the client may result in rescheduling or additional charges.
- The client is encouraged to maintain an open and cooperative approach to ensure the success of the service.
- Pricing and Scope Adjustments
- All quotes are valid for 30 days.
- Any adjustments to the project scope or pricing must be agreed upon in writing before the changes take effect.
- Additional charges may apply if the scope changes after the quote is agreed upon.
- Governing Law and Dispute Resolution
- The agreement is governed by Danish law.
- Any disputes will first be attempted to be resolved through mediation. If mediation fails, the dispute will be settled under the jurisdiction of Danish courts.
- Flexibility for Customization
- While these terms provide a standard framework, ELICITOR is open to minor adaptations for corporate or international clients to meet specific needs. These adaptations will be documented in writing
